These terms of use govern (a) your access to, and use of, the Virtual Behavioural Medicine E-learning Website (the “Website”) and (b) all written and other materials displayed or made available through the Website, including, without limitation, articles, text, worksheets, images, illustrations and video clips (the “Content”). By accessing and using the Website, you are indicating that you accept these terms and conditions, and any other notices posted on the Website. In these Terms of Use, the terms “we”, “us”, “our” and “Baycrest” refer to Baycrest Academy for Research and Education, and its affiliates (“Baycrest”). 

Informational Purposes of the Website  

The Website including any text, information, pictures, videos, data and displays is provided for informational purposes only. Nothing on the Website should be considered, or used as a substitute for, medical advice, diagnosis or treatment or as a substitute for your own clinical judgment as a healthcare professional, nor as a substitute for your employer’s policies and procedures. You agree to evaluate and independently verify the information and results provided by the Website against your own professional judgment. 

Availability of Our Website  

Our Website may be interrupted, including for maintenance, upgrades, or network or equipment failures. We may discontinue some or all parts of our Website, including certain features and the support for certain devices and platforms, at any time. We do not warrant that the Website will be operational, error-free or secure, or will function without disruptions, delays or imperfections.

To access and/or use certain areas and features of the Website, you are required to create an account. Upon registering for an individual account for the first time, you agree to: (i) provide accurate, current and complete information as may be prompted by any registration forms; (ii) maintain the security of your password; (iii) maintain and promptly update any registration data and any other information you provide; and (iv) accept all risks of unauthorized access to the registration data and any other information you provide. You are responsible for all activity under your account.

You are granted the right to download, store, and/or print the Content for your personal, non-commercial use, provided that you maintain all copyright and other notices contained in such Content. You may not copy and/or repost items comprising the Content online. Furthermore, you may not include any material from the Content in or with any product that you create or distribute, without the prior permission of Baycrest. You must also abide by any additional requirements governing the use of any specific Content that may be set out on the Website. Governing Law and Jurisdiction 

These terms of use, and the Website, are governed by the laws of the Province of Ontario and the laws of Canada applicable therein. Any dispute is to be submitted to a court of competent jurisdiction in the judicial district of Toronto, Province of Ontario. Baycrest makes no representations that the services or the Website is appropriate or available for use in other locations. Those who choose to access the services or the Website from other locations do so at their own risk and are responsible for compliance with any and all local laws. A printed copy of these terms and of any notice in electronic form shall be admissible in any judicial or administrative proceedings to the same extent and under the same conditions as other business documents and records originally generated and maintained in printed form.

Baycrest reserves the right to modify, alter or otherwise update these Terms of Use at any time without prior notice to you. You agree to be bound by any modifications, alterations or updates (“Changes”) and agree that any subsequent use by you of the Website following any such Changes shall constitute your acceptance of all such Changes.

We may, in our sole discretion, terminate your access to the Website, or any portion of the Website, without notice. Such action is in addition to, and not in lieu or limitation of, any other right or remedy we may have available at law. By accessing, browsing, registering with or using any part of the Website you agree that we may collect, use and disclose your Personal Information as described in this Privacy Policy. “Personal Information” means information about you or that may be used to identify you. “Account” means an account required to access and/or use certain areas and features of the Website. 

Collection of Personal Information

Baycrest does not collect Personal Information about you through the Website i) except when you specifically provide this information to us on a voluntary basis and ii) through
automatic information collection below.
Baycrest collects Personal Information to provide and manage your access to the Website, service evaluation and quality improvement, and in order to comply with legal and regulatory requirements. The Personal Information we collect for such purposes will include your name, email address, role (Health Care Professional or family/caregiver), city and province of residence, user name and password. 

Third-party services

We contract with third party vendors to supply certain features of the Website. For example, Baycrest operates the Website using a platform licensed by LearnWorlds (CY) Ltd. LearnWorlds will require access to some or all of your personal data. For more information about LearnWorld’s Privacy Policy, see https://www.learnworlds.com/privacy-policy/.
Once you leave the Website or are redirected to a third-party website or application by clicking on a link, you are no longer governed by this Privacy Policy. We are not responsible for the privacy practices of other sites and encourage you to read their individual privacy policies and statements. 

Automatic Information Collection

Baycrest automatically collects information as part of the standard operating process of the Website. The information collected includes your internet protocol (IP) address, cookie information and browsing actions and patterns such as user analytics.
A “cookie” means a small text file placed on your computer or device by our Website when you visit certain parts of our Website and/or when you use certain features of our Website LearnWorlds also uses cookies to collect information about the use of the Website and preferences and to customize and improve the Website. You can set your browser to refuse all or some browser cookies. If you disable or refuse cookies, please note that some parts of the Platform may become inaccessible or not function properly.

Security of Personal Information  

To protect your Personal Information, we take reasonable precautions to ensure it is not inappropriately lost, misused or accessed. The Website is hosted by LearnWorlds. LearnWorlds provides us with the online platform that allows us to offer the Website to you. LearnWorlds stores your information on a secure server in the United States and is a Google Cloud partner. You are responsible for maintaining the confidentiality of the password you use for the Website and are responsible for all activities that occur under your username and password. You agree to notify Baycrest immediately of any unauthorized use of your password or user name or any other breach of security, and to ensure that you exit from your Account at the end of each session. Although Baycrest takes reasonable precautions to protect your Personal Information, please note that no data transmission over the Internet can be guaranteed to be 100% secure. 

Retention and Storage of Personal Information

We will retain your Personal Information to fulfil the purpose for which we collected it, and for as long as necessary or as required by applicable law.

Note to Users Outside Ontario, Canada 

Baycrest is located and operated in Ontario, Canada. All matters relating to access to, or use of, this Platform shall be governed by the laws of the Province of Ontario and the laws of Canada, without regard to conflict of laws principles.
